Abstract
The rapid increase of technology and telecommunications and the development of informatics and internet in eveyday life has lead to a significant change in the way people communicate, personally and profesionally. Public administration and the services it offers towards the citizens is also affected by this evolution. The public sector of most countries today should be in position to follow the changes in society and communication.
This thesis is a study of the transformation of the society into an Information and Internet Society and the continuous attempt of public administration and legislation to adapt to this environment in order to provide to the citizens quality of living and security in trade. The transformation of the public sector through the model of e-governance is also presented, focusing on the targets of minimizing bureaucracy, costs of offered services and maximizing security of trade between citizens and enterprises and the Greek government. In this environment the Electronic Procurement System is applied.
Legislation framework concenring procurement is also analyzed, together with contracts and agreements as legal transactions, as well as the use of electronic signature, a milestone for the application of electronic contracts and the integrated system for the whole public sector.
Also presented is the methodology of creating government contracts, the electronic means that are used and the way these are validated under the greek and european laws. There is a detailed presentation of the evolution and current state of the legislation framework for goverment procurement on a EU- and national level, which provides an overview of the environment under which procurement and e-procurement are taking place. Moreover, there is another reference on the National Electronic System for Procurement (ΕΣΗΔΗΣ) in Greece, and the risks and benefits of its operation. The involvement of Ministry of Finance as contracting authority in the electronic system of goverment contracting is analyzed, giving also proposals on the implementation methods in terms of organisation and resource savings.
The thesis is completed with some conclusions that are followed by two appendixes. In appendix A is presented the article to article analyses and syntheses of P.D. 60/2007 that concerns the conformism of the Greek legislation in the rulings of legislative advisement 2004/18/EK. The analytical presentation of the specific legislation happens because this is part of basic legislative literature, concerning the co-ordination of the operations in order to facilitate public work contracts, commissions for the departments, as it has been adjusted and is currently in effect. In appendix B there is a recent declaration of an open internet competition, with the platform of (ESHDHS), through the internet portal www.promitheus.gov.gr of the system, for the ministry of Economics.
