This master’s thesis examines spyware from a European Union perspective, focusing on the forms and extent of its documented use, as well as the legal issues arising from it. Furthermore, the thesis analyzes the institutional and regulatory framework of the European Union (hereinafter: EU) applicable to spyware, while also assessing the effectiveness of the initiatives that have been developed to date to address this phenomenon. It should be noted that the scope of this thesis is not confined to the national legal order but extends beyond it, taking into account the broader global trend in the use of spyware and the risks this entails for the protection of the confidentiality of communications and personal data. Moreover, the thesis explores how spyware is often used as a tool for surveillance, the circumvention of safeguards, and political control, leading to the infringement of fundamental rights and the undermining of democratic institutions. The thesis concludes with the findings derived from the overall analysis and evaluation of these issues, along with the relevant reflections.
