This thesis examines the relation between patents and artificial intelligence, analyzing the current theoretical and legislative framework of patent law. It presents the basic concepts of invention, inventor and patent, as well as the role of artificial intelligence in research and development, in the context of the existing regulatory framework, particularly at the European Union level through the AI Act, which does not directly address intellectual property issues.
Particular emphasis is placed on the issue of whether artificial intelligence can be recognized as an inventor, highlighting the conflict between the traditional human-centered approach and the new technological reality. At the same time, the lack of transparency (“black box”) of artificial intelligence systems is examined, which complicates the attribution of inventive contribution and the application of standard legal criteria.
This is followed by a comparative overview of different legal jurisdictions, such as the European Union, the United States and the United Kingdom, where a common tendency to maintain the human-centered nature of patent law is observed. This approach is also confirmed by relevant case law, with the DABUS case being the prime example, as well as more recent decisions such as Emotional Perception AI Ltd and Recentive Analytics v. Fox Corp., which highlight the limits of the existing interpretation and the ongoing legal uncertainty.
Finally, the challenges arising from the use of artificial intelligence in the field of patents are analyzed, particularly regarding the adequacy of the legal framework and the implications for innovation, competition and the market, while proposing guidelines for a gradual and balanced adaptation of the existing legal framework, with the aim of balancing legal certainty and technological progress.
