Abstract

This paper examines the processing of personal data of platform workers, operating either as self-employees or under any other type of employment relationship. Platform work is claimed to have specific features, which are presented in combination with the various ways that this data processing is performed. All the methods and stages are examined and analyzed. Also, the legal basis for the personal data processing of platform workers, based on the General Data Protection Regulation, is listed. In addition, the use of automated monitoring or automated decision-making systems is examined along with the transparency requirements that the platform must comply with. In this context, a brief reference is made to the European Directive “On improving working conditions in platform work”. Furthermore, it is analyzed the right to collective representation and the way in which it is exercised by all platform workers through the provisions of both the Directive and national legislation. In this context, the paper also highlights the distinction that the Directive makes between the two categories of platform workers in the exercise of this fundamental right in relation to the effects of the algorithmic management. Additionally, the study examines the right of the individuals, performing platform work, to the protection of their personality with reference to indicative cases of infringement. The study concludes that the Platform Work Directive is an innovative regulation with a particularly human-oriented approach. However, the Directive is not sufficient enough by itself to resolve all the issues arising from data processing and the use of algorithmic management systems. The legislative regulation of algorithmic management, specifically in the workplace, seems to be an urgent necessity.
