The practice of surrogacy gives rise to significant ethical concerns pertaining to the commercialization of the womb, the devaluation of women, and the exploitation of third parties. Nevertheless, it appears that the pervasive influence of conventional gender norms and the emphasis on safeguarding the “sanctity” of motherhood have resulted in the infringement upon a woman's right to autonomy, effectively excluding her from the discourse. The decision to participate in a surrogacy contract and to accept compensation should be at the discretion of the surrogate mother. It is this author’s position that the law should facilitate access to this market, as the woman herself is the most knowledgeable about her own interests. This paper ultimately argues for such a regulatory framework that takes into account the experiences of surrogates, for the inclusion of all childless individuals who wish to utilize this method, and for genuine social justice in the field of reproductive assistance.
