On the first part of this study, an effort will be made for a thorough presentation of the general meaning of patents, and how they become essential for the establishment of a standard, obtaining the status of SEP (standard essential patent). Meanwhile, their overall differences from common patents that don’t serve this specific purpose will be pointed out. For these needs a brief description of what exactly a standard is, and serves in the market of technology will be attempted. Moreover, the study will make a quick overview concerning the role that play the most significant Organizations in the process of standardization. In the ending of this first part, a reference will be made on the way that SEP holders use their patents in order to exclude their existing or potential competitors in the market and questions will be raised of whether the status of the essential provides for the patent holder a certain lead or even dominance in the market.
Proceeding in the second part of this study, we will investigate whether this above-mentioned lead against his competitors from the SEP-holder, is also translated as the possession of a dominant position in the market that he operates. This specific form of dominant position which is obtained from the possession of an essential technological asset leads necessarily to specific abusive practices from the part of the SEP-holder. Thus, apart from the general forms of abusive practices that can be encountered in the matter, specific attention will be given to the practices of the so called “refusal to license” and “patent hold-up”, as particular forms of abusive behaviors from the SEP-holder.
