Abstract

This study attempts to provide a concise overview of the important and highly topical issue of whether or not communication metadata should be included in the scope of communication secrecy. Having as a starting point the essential processing of the concept of communication metadata, the dialogue on the conceptual approach to the term commences, with the ultimate aim of highlighting its importance over time and in line with the developments that each era brings. At each stage of the conceptual approach to metadata, an additional aspect of metadata is brought to light, leading directly and spontaneously to the conclusion that communication metadata is not a unilateral reflection of space and time, location and duration. Rather, metadata is an essential source of information that can greatly contribute to the understanding of the communication event by identifying, documenting, and enriching it. Therefore, once the concept of metadata has been established, there is a legitimate need for a brief but comprehensive reference to the concept of communication secrecy, in order to lead the reader smoothly to the main topic of the study, namely whether such data are protected or should be protected by constitutional secrecy. By presenting arguments from both sides of legal theory, both for and against such inclusion, the course of legal thinking on the matter is clarified. This approach cannot fail to take into account the current state of affairs, in the sense of reviewing the relationship between metadata and the issue under analysis in the context of today's technological reality. It is therefore necessary to refer to new technologies, and in particular to artificial intelligence technologies, the further analysis of which provides a wealth of information on the subject of this study. Therefore, provided that the individual parameters that significantly affect the issue in question have been analyzed with the desired accuracy and clarity, the author attempts to draw a conclusion, which, although personal and thus subjective, seeks to eliminate individual unilateral conclusions and highlight the most legally sound approach.
