Abstract

This thesis deals with the issue of distortions of competition in public tendering procedures. Its aim is to gather and present the factors that distort competition and in particular the ways to address them in a single framework. To this end, it focuses mainly on the factors that unfairly distort competition, on the way in which they can be identified, prevented and/or avoided by the competent authorities and on the various legislative regulations, actions and practices that have been developed at international, European and national level, especially in recent years. A comprehensive presentation of this issue can contribute to a better understanding of it and therefore to the search for more efficient and effective ways to address it. The first chapter describes the importance of ensuring the development of optimal conditions of competition during the conduct of tender procedures, the legislative framework of public procurement and competition and the protection of free competition through it. The second chapter analyzes the characteristics of the public procurement market that favor distortions of competition and the distortion factors, with particular emphasis on corruption and collusion. The third chapter presents the indicators of corruption and collusion in public procurement and the fourth chapter presents the most recent cases of corruption and collusion in public procurement tenders in European Union countries. Finally, the ways of dealing with distortions are analyzed.
