In the context of the modern digital market and the expanded use of the internet, Subjects are increasingly providing their personal data in exchange for the supply of digital content or services. The EU legislator, in an attempt to address the issue, adopted Directive (EU) 2019/770, which was transposed into Greek law by Law 4967/2022, under which the possibility of using personal data as consideration in the context of transactions for the supply of digital content or services is provided.
The aim of this thesis is to study the legal recognition of the transactional nature of personal data by the EU and national legislators, as well as to highlight issues surrounding the permissibility or otherwise of their marketability. In this way, Chapter 1 will address the issue of the commercialisation of personal data in general, while Chapter 2 will examine the legal recognition of their transactional nature. Chapter 3 will analyse legal issues that arise in the context of contracts where the consideration of the recipient of the principal supply consists of the provision of personal data. Finally, Chapter 4 will examine issues of the legal protection of personal data in the light of substantive and procedural law, and will attempt a correlation with the GDPR.
The paper concludes that the aim of the legislator is to protect the privacy of Data Subjects. Therefore, it is guided by the thought that the legally recognized transactional nature of data should in no way disturb the balanced development of individuals’ personality.
