This present paper is aiming to examine the new institutional framework formed in the field of maritime transport by the gradual insertion of the electronic bill of lading in it.
In the above context, an attempt will be made to present the main parties involved in a typical contract of maritime transport, while at the same time it will be attempted to achieve their correlation, regarding their rights and obligations deriving from the bill of lading not only as a proof document, but also occasionally as the transport contract itself. At the same time, there will be raised the issues as well as the possible negative effects that may occur on the maritime trade due to the transactional “obsession” in the use of a bill of lading in paper form, while consequently there will be analyzed the multiple advantages but also any difficulties that may arise from the establishment of the electronic bill of lading. There will be made a specific mention to the standard clause of BIMCO for application in the field of the electronic bill of lading and how it should be considered more appropriate in relation to other alternative systems.
Finally, it should be emphasized that despite the obvious and significant advantages that the electronic bill of lading may offer, the field of the international transport is not yet completely prepared for its universal acceptance and establishment.
