dc.description.abstract	Η παρούσα εργασία αποτελεί μια προσπάθεια κριτικής και ερμηνευτικής προσέγγισης του νομικού πλαισίου που διέπει τις μεθόδους ιατρικής υποβοήθησης στην ανθρώπινη αναπαραγωγή. Ειδικότερα, αναλύεται το ζήτημα της post mortem γονιμοποίησης και καθορίζονται οι προϋποθέσεις του επιτρεπτού της. Παράλληλα, προσδιορίζονται οι ελλείψεις στο προϊσχύον δίκαιο και γίνεται εκτενής αναφορά στις πρόσφατες νομικές ρυθμίσεις, ενώ παρατίθενται και στοιχεία συγκριτικού δικαίου ώστε να εξαχθούν τα ανάλογα συμπεράσματα για την κάθε χώρα ξεχωριστά. Ως προς την προβληματική της μεταθανάτιας τεχνητής γονιμοποίησης, παραβάλλεται επιχειρηματολογία για το επιτρεπτό της μεθόδου και επισημαίνονται οι αντιδράσεις ενάντια στην εφαρμογή της. Επίσης, υπογραμμίζονται οι κυριότερες ηθικές και κοινωνικές προεκτάσεις επί του θέματος. Τέλος, κρίθηκε αναγκαία η αναφορά στον καθοριστικό ρόλο του βιοδικαίου καθώς και η συνδρομή των διεθνών κειμένων στην εύρεση πρακτικών λύσεων και στην ενιαία αντιμετώπιση των προβλημάτων που προκύπτουν από τις βιοϊατρικές εφαρμογές.	el

dc.description.abstractEN	The present paper is an effort of critical and interpretational approach of the legal frame concerning the methods of human medical assisted reproduction. In particular, the issue of post mortal fertilisation is analysed and the conditions with which it is allowed are defined. In parallel, the shortcomings of the formerly effective law are assessed and the recent legal arrangements are thoroughly reviewed. Also, evidence of comparative law is being cited in order to derive the relevant conclusions for each individual country. Concerning the problematic issues of post mortal IVF, arguments are being cited about the way the method is allowed and the reactions against its appliance are being examined. Also, the main ethical and social issues arisen by this issue are being underlined. Finally, the reference to the important role of the biology law was necessary as well as the reference to International Laws towards finding practical solutions and facing uniformly the problems arising by biomedical applications.	el
