This thesis is to examining the criminal and administrative responsibility of the master and crew and subsequent penalties provided the existing legislative framework. For present purposes, we will attempt an overview of the legal framework regarding the position of captain and crew in connection with the operation of ships. Specifically is highlighted the dominant role of the master, who with his capacity has powers recognized by law which make him liable to the owner, crew and third parties. As for the crew a description of their duties arising by law is attempted in connection with the maintenance of order, discipline and hygiene required to be kept on board.
