The primary focus of the present postgraduate thesis is the interrelationship between artificial intelligence and copyright law, emphasizing in particular works created through artificial intelligence algorithms. Specifically, this thesis explores the theoretical foundations of the concepts of creation and originality in the context of works produced by artificial intelligence systems, and subsequently outlines the international and comparative legal framework regarding the protection of such works.
Emphasis is particularly placed on the legislation of the European Union, the United States of America, and China, with the aim of analyzing and comparing the different approaches to the issue of recognizing copyright in AI-generated works and determining their author. In parallel, key legal issues are examined, such as whether works produced through AI systems can be considered works within the meaning of copyright law, as well as which party may be considered the holder of the relevant rights—whether it is the user, the software owner, or the developer of the artificial intelligence system.
Lastly, contemporary theoretical and jurisprudential approaches regarding the need to establish an appropriate regulatory framework for the protection of intellectual property rights in the age of artificial intelligence are introduced and examined.
