The present thesis examines the fundamental transition of EU competition law from
a formalistic (form-based) approach to a more economics-oriented analysis (effects-based
approach), within the framework of Article 102 TFEU. The study focuses on the evolution
of case law, starting from the traditional rigidity of the Hoffmann-La Roche era and
culminating in the landmark Intel (2017/2024) decisions, which established the "As Efficient
Competitor" (AEC) test as a central methodological tool.
Through the analysis of modern legal theory (Ibáñez Colomo, Vesterdorf), the
challenges emerging in digital markets are explored, such as the practice of "selfpreferencing"
in the Google Shopping case. The thesis highlights the tension between the
need for economic efficiency and the preservation of legal certainty, pointing out the risk
of imposing a "probatio diabolica" (devil's proof) on dominant undertakings. Finally, it
evaluates the "second modernization" of Article 102 and the emergence of the Digital
Markets Act (DMA) as a means of addressing the inherent limitations of ex-post antitrust
intervention.
