The rule of law, a classic subject of legal philosophers throughout world history, has in recent years become a field of research into the law of the European Union , with much ink having been spilled on the analysis of this principle both from the point of view of its application by the Member States and by the institutions of the Union. The importance of analysing this subject is inextricably linked to the efforts made by societies to safeguard democracy , a constitution which, at various times in history, has been subject to the attempts of various authoritarian regimes to overthrow it. After all, democracy is the only constitution capable of guaranteeing the rule of law at a time when the recurrence of a generalised war does not seem such an inconceivable or distant scenario.
The Court of Justice of the European Union, entrusted by the Treaties to safeguard the legality and control the action of its institutions, is the main guarantor of the principle under consideration. The review of its recent case law therefore seeks to remind the reader that his fundamental rights continue to be safeguarded within the European legal autonomy, confirming the Union's exceptional capacity to adapt under the pressure of constantly changing circumstances.
