This paper deals with whether or not digital currencies are included in the crime of Computer Fraud. At the beginning, the subjective and objective nature of Computer Fraud in article 386A of the Greek Penal Code is analyzed, as well as the changes brought about in this article by law 4619/2019. Then an attempt is made to understand the concept of cryptocurrency, and in particular that of bitcoin, through an analysis of its legal and non-legal nature, in order to finally examine whether the latter can be included in article 386A, fulfilling the objective nature of this provision of the criminal code.
