The National Gas System Operator (DESFA) was established following the hiving-off of the national natural gas transmission system (ESFA) division from the Public Gas Corporation (DEPA) and is the national operator of the national transmission system and LNG facility, having as its main responsibility the provision of access to third party users to the national gas network in a transparent and non-discriminatory manner among several users or categories of ESFA users. The role played by DESFA as the operator of the ESFA is of key importance and is linked to the proper functioning of the natural gas market, since free access of users to the natural gas network, as an essential facility for transporting natural gas and carrying out any other transactions on the natural gas market, in accordance with the doctrine of ‘essential facilities’, is a key condition for the development of competition in the natural gas market.
DESFA’s transactions with ESFA users are governed by standard framework contracts, on the basis of a pre-defined content, which is approved by the Regulatory Authority for Energy (RAE). The operation and evolution of the standard framework contracts are important not only for the contracting parties — DESFA and the ESFA user — but for the entire natural gas market, since a breach of these contracts may hamper or block the access to the network, thus disrupting the functioning of the natural gas market. The smooth implementation of these standard framework contracts requires close cooperation between the contracting parties, with ESFA users bearing important obligations towards DESFA, which are crucial for the proper performance of its responsibilities by the latter. In this context, the liability of the contracting parties is regulated not only by the standard framework contracts, but also in the Code for the Management of ESFA in a strict manner, providing for specific cases of infringements and respective penalties for the contracting parties.
