In principle this thesis examines the concept of piracy as an international criminal act, affecting various parties of the marine industry.
Firstly, this study presents the contemporary situation as regards to the incidents in the piracy affected areas of the world, as reflected in the statistical overview provided by the International Chamber of Commerce.
In particular, this post-graduate thesis refers to the marine insurance products that have been created in order to protect the operation of maritime business against losses due to piracy. Mostly, though, the purpose of this research is to analyze the legal issues arising in the context of drafting a charterparty or determining the liability between the shipowners and charterers or covering the costs of ransoms for kidnapped crew members. On a last note, this thesis will mention the implications of the use of armed guards on board the merchant ships and its legal prerequisites basis the international legislation and the Flag State’s position.
