The following thesis deals with accidental pollution, ports of refuge and the legal framework in the E.U and Greece. At first is given a short description of accidental pollution, the legislation on double-hulls and whether they are answer to pollution or just a partial solution. The second and third chapter describes port state control and the Vessel Traffic Monitoring System. The main issue is the relationship between the maritime, coastal and port authorities of a state and a ship in distress, which is seeking a port of refuge. The IMO legal Committee gives guidance on finding instruments for liability and compensation issues for damage resulting from a decision to grant or deny a ship a port of refuge. The thesis also describes a new compensation regime for ports of refuge, the IMO Guidelines in international level and the most terrible tanker accidents as Case studies. In the end we give all the concluding remarks and what we can do in order not to have another Prestige in the future.
