| dc.description.abstract | Η παρούσα διπλωματική εργασία εξετάζει την αστική ευθύνη των μαιευτήρων γυναικολόγων, εστιάζοντας στην αξία της ασφαλιστικής κάλυψης, καθώς και στο ισχύον νομικό πλαίσιο. Οι ιατρικές πράξεις της ειδικότητας αυτής, συγκαταλέγονται στις υψηλού κινδύνου, καθώς αφορούν τόσο την ζωή και την προστασία της γυναίκας όσο και του εμβρύου. Οι πράξεις αυτές συνεπάγονται αυξημένη πιθανότητα αποζημίωσης και σημαντικές οικονομικές επιπτώσεις.
Στο θεωρητικό μέρος της εργασίας πραγματοποιείται βιβλιογραφική ανασκόπηση σχετικά με το ισχύον νομολογιακό και νομοθετικό πλαίσιο, τις ιδιαιτερότητες της συγκεκριμένης ειδικότητας και την εξέλιξη της ιδιωτικής ασφάλισης στην Ελλάδα. Επιπλέον, αναλύονται οι παράγοντες που επηρεάζουν τον καθαρισμό των ασφαλίστρων επαγγελματικής αστικής ευθύνης μαιευτήρων γυναικολόγων και ο τρόπος που οι ασφαλιστικές εταιρίες διαχειρίζονται τον ασφαλιστικό κίνδυνο.
Η ερευνητική προσέγγιση βασίστηκε σε δεδομένα που συλλέχθηκαν από την ελληνική ασφαλιστική αγορά με στόχο να εντοπιστούν τα σημαντικότερα κριτήρια που λαμβάνονται υπόψιν για τον καθορισμό του ύψους των ασφαλίστρων και τον τρόπο που διαμορφώνεται η ασφαλιστική κάλυψη.
Τέλος, τα ευρήματα της εργασίας αναδεικνύουν την στενή σύνδεση μεταξύ της συχνότητας και της σοβαρότητας των ιατρικών σφαλμάτων, της ασφαλιστικής πρακτικής και του κόστους της ασφάλισης. Παράλληλα, επιβεβαιώνεται η ανάγκη ασφαλιστικής κάλυψης, που συμβάλλει στην οικονομική κάλυψη των επαγγελματιών υγείας, των ασθενών και στην διασφάλιση της ποιότητας των παρεχόμενων υπηρεσιών. | el |

| dc.description.abstractEN | The present thesis attempts to analyses the situation which exists in the civil liability of obstetrician and gynecologists, focusing on the role, applicable legal framework and judicial practice. This medical specialty is considered one of the highest risk medical specialties, as the decisions directly affect both the mother and the fetus, resulting in an increased substantial financial consequences and likelihood of malpractice claims.
The theoretical part of the study provides a comprehensive literature review of the evolution of private health insurance in Greece, the legal principles governing medical civil liability, relevant legislation and case law, and the characteristics of civil liability in obstetrics and gynecology. Furthermore, the study explores the factors influencing the calculation of professional liability insurance premiums and examines the methods employed by insurance companies in assessing and managing professional risk.
The empirical part of the research is based on the collection and analysis of data from the Greek insurance market, aiming to investigate the current structure of professional liability insurance for physicians. Particular emphasis is placed on identifying the key criteria used by insurance companies to determine annual insurance premiums and evaluating the relative importance of each factor, especially in relation to obstetricians and gynecologists.
The findings demonstrate a strong relationship between the frequency and severity of medical malpractice claims, judicial decisions, insurance underwriting practices, and the cost of professional liability insurance. The study highlights the necessity of effective liability insurance coverage as a mechanism for protecting healthcare professionals from financial risk while simultaneously promoting patient safety, high-quality healthcare services, and greater confidence in the healthcare system. Finally, the research contributes to a better understanding of the challenges associated with professional liability insurance in high-risk medical specialties and provides useful insights for healthcare professionals, insurers, and policymakers. | el |
