This thesis examines the relationship between EU competition law and sustainability, and the
tradeoffs and synergies involved in directing market conditions to support environmental as well
as social objectives. The study looks at key sheets of the Treaty on the Functioning of the European
union (TFEU), comprising Articles 101 and 102, and their ability to assist sustainability initiatives
through exemptions and flexible enforcement. The thesis through detailed analysis and case studies
of Dutch sustainability initiatives and energy market agreements, illustrates the tensions between
short term market competition and long-term sustainability goals. Additionally, it uncovers
synergies such as the promotion of green innovation and the support for market player
collaboration in creating competitive frameworks that facilitate sustainable practices. This finding
calls for a balance approach to competition law that takes sustainability as an integral aspect of
competition in the same way it is observed as a core consideration without violating its core
principles. Careful policy recommendations are suggested including clearer guidelines for
sustainability agreements, stronger enforcement against greenwashing and extending the frontiers
of competition law to take account of non-economic benefits. This research contributes to the
ongoing debate on how the EU competition law may evolve to better advance the European Green
Deal and ultimately global commitments to sustainability.
