Abstract
This study analyzes the general average institution. It examines the contemporary case – law and general average is correlated with insurance science and practice. General average is defined as far as ship and cargo is concerned and sacrifices about cargo are examined. It analyzes the conditions under which general average exists and specifically common shipping adventure, risks, voluntary or intentional loss, extraordinary and logical sacrifice. It also analyzes marine environment pollution issue that is connected with general average and it ends up with the liquidation process and involved interests that take part in this procedure. Moreover, two cases are examined. One of them constitutes a true case and is about general and particular average and the other constitutes an hypothetical case about the adjustment. Finally, conclusions and propositions are extracted for scientific and practical speculation.
