This postgraduate thesis examines the image of the individual as an aspect of personality rights, focusing on its protection within the framework of privacy in the modern digital age. It analyses the concept of privacy and the case law concerning image rights violations at both national and European levels. The thesis also focuses on the protection of one’s image as personal data and its use on the internet. Contemporary forms of image processing through artificial intelligence technologies are explored, including remote biometric facial recognition systems, deepfakes, and large language models. In this context, the General Data Protection Regulation (GDPR) and the new Artificial Intelligence Act (AI Act) are also examined. The study concludes with a comprehensive account of the current challenges faced by the right to one’s image, particularly within the environment of social networks and generative artificial intelligence.
