In this paper, the subject at hand is the principle of good faith in marine insurance and
its relationship with Greek law. As an introduction to the work, we will talk about the
concept of both the risk due to which the institution of insurance exists, as well as the
insurance itself contained in marine insurance contracts. Then there will be a private
talk about marine insurance and its characteristics, with the main characteristic of risk.
The types of marine insurance will also be developed in the same chapter.
In the following chapters of the work, reference will be made to the concept of good
faith in marine insurance as it is established in English law. As a continuation of this
analysis, it is also considered appropriate to approach the concept of good faith
according to what is in force in Greek law, by comparison with English law. For this
reason, the concept of good faith will be analyzed in accordance with what is defined
and provided for by the Greek legal order with reference, however, to the provisions
of our civil code. Reference will also be made to the obligations arising between the
parties to a marine insurance contract in both Greek and English law, as these
obligations constitute the specialization of the principle of good faith and the way in
which the principle is marketed.
What is also going to concern us is, in addition to the principle of good faith as
established in English law, and the principle of the so-called "ultimate good faith". A
principle which, however, is not completely unknown in Greek law, and from this the
principle in question will be analyzed in accordance with the provisions in force in the
Greek territory. In order to make this principle clear in terms of English law,
jurisprudence is also going to be cited.
Finally, the paper will close with the connection of good faith with the law of marine
insurance in order to know the way in which this principle is interpreted but also in
order to establish the future perspectives that are likely to affect the field of marine
insurance.
