The posthumous exploitation of artists' images raises diverse and complex legal, ethical and social issues. In the context of this study, the issue of the protection of personality elements after the death of an individual is analyzed, with particular emphasis on the commercial exploitation of the image and voice of artists. Rapid technological developments, such as the use of computing and other technologies to 'resurrect' actors, highlight the need for a modern and effective legal framework.
The legal regime in Greece will be examined, where the protection of personality elements is limited, as the right of personality is considered personal and is extinguished upon the death of its bearer. Post-mortem protection is ensured under Article 57 of the Civil Code, which protects the memory of the deceased, allowing close relatives to claim the removal of insults. However, this provision does not cover the commercial dimension of personality. A comparative analysis with legal orders of other countries, such as the United States, France and Germany, will follow. Through this analysis, cases of recognition of the transfer and inheritance of the commercial exploitation right will be cited, and a detailed reference will be made to litigation concerning personalities known throughout the world.
The study concludes that the absence of a uniform and clear regulatory framework creates legal loopholes, which necessitate legislative intervention. It is proposed to develop regulations to ensure the protection of personality both during life and after death, while adapting to modern technological and social developments. Recognizing the commercial dimension of personality and providing adequate protection for the rights of authors and heirs is considered necessary to maintain a balance between moral rights and economic prospects in an ever-changing world.
