The subject of the thesis critically evaluates the right to privacy of communications. It analyzes the legal protection allo ed to private communications against state surveillance, se ing it against the right of the state to provide social security in the digital age. This theme is particularly addressed within the legal framework, covering the right to privacy and state surveillance, under international treaties, legislation of the European Union, and, as binding decisions, case law of the European Court of Human Rights (ECtHR). The focus is placed on the threats that the quick turnover of technological changes brings, while assessing whether legal mechanisms in existence nowadays are effective enough to protect confidentiality in communication. It further discusses critical landmark ECtHR cases by providing insights on the balancing of the right to individual privacy against national security interests. Finally, some conclusions are drawn, and future research implications are suggested to contribute to the ongoing debates on privacy and surveillance.
