This thesis examines the issue of intellectual property rights regarding avatars in the metaverse, analyzing the evolution of digital identity and the legal implications arising from the interaction between users. First, it approaches the importance of avatars and the need for legal protection in a world where digital interactions are becoming increasingly important. The first chapter provides a historical overview, discussing the definition and characteristics of avatars. At the same time, the legal issues arising from their interaction, such as potential rights violations and the need for new regulations, are examined. In the second chapter, the concept of the legal personality of avatars is discussed, as well as the possibility of recognising them as subjects of rights. The third chapter focuses on the issues of intellectual property protection of avatars, highlighting the challenges faced by creators and users in the metaverse and analysing the existing legal framework for avatar intellectual property in video games. In chapter four, we explore the different types of IPR protection that can be applied to avatars, such as protecting them as trademarks or as works. In addition, chapter five examines inventions within the metaverse and their patentability. Finally, in chapter six, end-user license agreements and their legal consequences if applied in the context of legal protection of avatars are discussed. The paper concludes on the need to create a clear legal framework in order to protect creators and users in the digital environment of the metaverse with regard to the avatars that will be created.
