The purpose of this essay is the examination of the liability of online content-sharing service providers
for use of content protected by copyright and related rights under Article 17 of Directive (EU)
2019/790 on copyright and related rights in the Digital Single Market. In the first Chapter, we focus
on the pre-existing legal framework of liability, in particular the right of communication to the public
of works under Article 3 of the Directive 2001/29/EC, the “safe harbor” liability exemption regime
for hosting service providers under Article 14 of the Directive 2000/31/EC and the possibility to apply
for an injunction against intermediaries under Article 8(3) of the Directive 2001/29/EC. We then
proceed to examine the existing liability regime, discussing the path towards the adoption of the
Directive (EU) 2019/790, the objectives of the reform initiative undertaken by the EU legislator, the
key points of Article 17 and the guidance issued by the Commission regarding the provision at issue.
In the next Chapter, we analyze the decision reached by the Court of Justice of the European Union
in case C-401/19 concerning the action of annulment of Article 17 brought by Poland against the
European Parliament and the Council of the European Union. In a fourth and final Chapter, we
approach the “next day” in light of the transposition of Article 17 by member states and the Regulation
(EU) 2022/2065 which replaces the liability regime of Articles 12 to 15 of the Directive 2000/31/EC
in force for more than two decades for information society service providers with Articles 4 to 6 and
8 of the Regulation and introduces due diligence obligations for providers of intermediary services
marking the beginning of a new era.
