Abstract

After a brief presentation of digital evidence and its specific characteristics, it is necessary to highlight under which conditions such evidence can be admitted by the courts, in accordance with the soft law rules established by various organisations regarding the collection, analysis and presentation of evidence. In the following, we will focus in particular on the digital evidence resulting from the use of devices interconnected through the Internet of Things (hereinafter IoT) and the specific characteristics of mobile and wearable devices in terms of data collection capabilities. The specific nature of the Internet of Things makes investigating crime through the seizure and laboratory examination of digital evidence a particularly difficult process for investigators. A specific subcategory, with regard to digital forensics, is the investigation of crime in an Internet of Things (IoT) environment. Noting that the data of these devices, that interact with each other, are stored on the wearable devices - evidence themselves, but also, primarily, in cloud computing, we will discuss the legal framework for the seizure and analysis of such evidence based on the current regulatory framework in our country. Then, we will address the legal issues that arise in relation to privacy protection, in particular the concerns regarding the waiving of the confidentiality of communications and the protection of personal data, in the context of crime investigation in a computerised environment. Finally, we will present the next initiative of the European Union, in order to facilitate the access of the authorities to the disputed evidence, as well as other developments and initiatives regarding the investigation of crimes with the collection of digital evidence.
