In the present thesis we will examine the institution of the penal clause in terms of its financial / economic aspect. We will start with the description of the characteristics of the penal clause according to the Greek civil law, we will refer to the economic aspect of the penal clause and in the case of the imposition of this excessive and its treatment. In order to examine the issue in detail, we will develop Posner's theory and we will consider a comparative analysis of the operation of this institution in Greek, Anglo-Saxon, French and Italian law. Our development will be based on theoretical assumptions and detailed case law examples in order to make it as clear as possible.
